Preliminary draft. This is a working draft of Drivesey's terms, published so the in-app references go to a real page. Final terms are pending review by counsel. By using Drivesey you agree to these terms as they stand today; we'll notify users of material changes when counsel's revisions land.

These Customer Terms of Service ("Terms") are a binding agreement between you ("you", "Customer") and Drivesey, Inc. ("Drivesey", "we", "us"). By posting a delivery, accepting a Driver's bid, or otherwise using the Drivesey platform as a customer, you agree to these Terms.

2. Drivesey is a marketplace, not the delivery service

When you accept a Driver's bid, you enter into a delivery contract directly with that independent Driver. Drivesey is not a party to that contract. Drivesey provides the platform, payment processing, identity verification, and dispute mediation; the delivery itself is performed by the Driver as an independent business.

3. Posting a delivery and accepting a bid

You name the price you're willing to pay; Drivers bid against that price or accept it. Each bid is displayed with: the Driver's name, the bid amount, and the Driver's per-minute wait-fee rate (see Section 6). Accepting a bid is your agreement to the full set of terms displayed on that bid card for that delivery.

4. Payment

At the moment you accept a Driver's bid, your card is authorized for the delivery fee, the Drivesey platform fee, any tip you've pre-selected, and a card-processing surcharge sized so the surcharge exactly covers the payment processor's fee. The authorization is captured only when the delivery is confirmed dropped off by the Driver. You are not charged for a delivery that does not happen.

5. Tips 100% to your Driver

Tips are optional. One hundred percent (100%) of any tip you pay through Drivesey is transferred to your Driver; Drivesey takes no percentage or processing fee from tips. You may also indicate a cash tip at checkout; cash tips are recorded for the Driver's records but are never charged or held by Drivesey at any time.

6. Wait fees the section to read carefully

6.1 The agreement

Each Driver sets the per-minute rate at which they will be compensated for time spent waiting on an order that is not ready at a pickup. The Driver's rate is shown on their bid card before you accept. By accepting a bid, you authorize Drivesey to charge your card on file for any wait fee accrued under that bid's rate.

6.2 How the fee is calculated

The wait fee is calculated per stop, then summed:

One hundred percent (100%) of the wait fee is paid to the Driver. Drivesey takes no portion. The wait fee is charged as a separate transaction at the time of delivery and appears as "Drivesey wait fee" on your statement.

6.3 How a Driver may start a wait timer

A Driver can only start a wait timer when they are physically present at a stop. Drivesey enforces this technically: a wait timer cannot be started from a remote location, from a stale location reading, or without the Driver's device location services enabled. A Driver who attempts to start a timer from outside the stop receives a refusal and the timer does not run.

6.4 Locations we cannot fence

A small percentage of pickup addresses (typically rural addresses) cannot be resolved to precise coordinates by our geocoder. In those cases the geofence cannot be enforced technically, the timer is logged as "ungeofenced", and enforcement relies on the dispute process below.

6.5 Disputing a wait fee

You may dispute any wait fee within thirty (30) days of the charge by contacting support@drivesey.com. Drivesey will review the Driver's location reading at the start and end of the timer, the audit log for the stop, and any messages exchanged between you and the Driver, and will refund any portion of the fee not supported by the record.

7. Cancellations and stalls

If an assigned Driver does not collect your order within the pickup window after your payment authorization, the job is automatically released back to the open board for another Driver to accept, and your card authorization is cancelled. You will not be charged for a delivery that does not happen.

8. Location and your Driver's ETA

During an Active Delivery, Drivesey shares your Driver's approximate distance and estimated arrival time with you, derived from the Driver's most recent device location reading. We store only the latest reading (overwritten with each new reading), never a track or history, and we clear the reading the moment the delivery is marked complete.

9. Items, food, and limitation of warranty

Your Driver is your neighbor in their own car, not a courier with a heated bag, professional packaging, or specialized handling equipment. Drivesey makes no warranty as to the condition, temperature, or quality of items collected and delivered through the platform. The Driver and the merchant are responsible for the items; Drivesey's role is to connect you with a Driver willing to make the run at the price you've named.

Drivesey does not support, and you may not use the platform to request, the pickup or delivery of:

These categories carry age-verification, licensing, privacy, or safety obligations that a peer-to-peer marketplace and its independent Drivers cannot satisfy. A Driver may refuse, cancel, and report any delivery they reasonably believe involves a prohibited item, without penalty of any kind. Requesting a prohibited delivery is a material violation of these Terms and grounds for account suspension. Drivesey does not inspect items and assumes no responsibility for a Customer's misrepresentation of an item's contents.

12. Account suspension and termination

Drivesey may suspend or terminate your account for any material violation of these Terms, including fraudulent payments, requesting prohibited items, abuse of the dispute process, or abuse of Drivers. You may close your account at any time by contacting support; we will retain only the records required by law and our payment processor.

13. Limitation of liability

To the maximum extent permitted by law, Drivesey's aggregate liability arising out of or relating to your use of the platform is limited to the fees you've paid to Drivesey (excluding amounts transferred to Drivers) in the six (6) months preceding the claim. Drivesey is not liable for indirect, incidental, special, consequential, or punitive damages.

14. Governing law and contact

These Terms are governed by the laws of the State of Arizona. Disputes that cannot be resolved through Drivesey's internal process will be handled in the courts of Navajo County, Arizona.
